BETA TERMS OF SERVICE
1. ACCEPTANCE OF TERMS
By accessing or using the Bulldozer Credit Analysis Tool (the "Tool"), you agree to be bound by these Beta Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Tool.
This Tool is operated by Bulldozer Engineering ("we," "us," or "our"), accessible at https://bulldozer.life.
2. BETA STATUS AND LIMITED AVAILABILITY
2.1 Beta Testing. The Tool is in BETA testing phase. It is provided solely for testing and feedback purposes.
2.2 Beta (Pre-Release) Status; Experimental Nature. You acknowledge the Tool is pre-release software (Beta), is experimental, and may behave unpredictably. There is a high risk of errors, inaccuracy, interruptions, data loss, and other failures.
2.3 Beta Disclaimer (As-Is; No Uptime/Accuracy Guarantee). The Tool is provided during beta on an "as-is" and "as-available" basis. We do not guarantee the Tool's accuracy, completeness, availability, uptime, or that it will operate without interruption or error.
2.4 No Guarantees. The Tool may contain bugs, errors, and defects. Features may change or be discontinued without notice. We make no commitment to continue offering the Tool after the beta period ends.
2.5 Free Access. During the beta period, access to the Tool is free of charge. This may change after beta testing concludes.
3. USE OF THE TOOL
3.1 Permitted Use. You may upload credit card statements, debt information, and related financial documents ("Financial Data") to receive automated credit analysis for personal, non-commercial testing purposes only.
3.2 Eligibility. You must be at least 18 years of age, a resident of the continental United States, and legally capable of entering into binding contracts to use this Tool.
3.3 Your Responsibility. You are solely responsible for:
- The accuracy and legality of any Financial Data you upload
- Ensuring you have the right to upload and share the Financial Data
- Any decisions you make based on the Tool's analysis
- All risks associated with using this Beta Tool
4. DATA SECURITY, HANDLING, AND PRIVACY
4.1 Reasonable Expectation of Privacy in a Beta Environment. We will take reasonable steps to protect your Financial Data and to limit access to it. However, because the Tool is an experimental Beta product, you acknowledge and agree that your expectation of privacy is limited to the reasonable efforts we can provide under the circumstances of an experimental Beta environment.
4.2 Data Handling & Deletion. Financial Data is uploaded for Beta testing and evaluation of the Tool. We will store and process your Financial Data with reasonable safeguards, and we may delete or destroy your Financial Data at any time, in our discretion, unless required to retain it by law.
4.3 Data Use. We will:
- Use reasonable safeguards to protect your Financial Data during the beta period
- NOT sell, rent, or transfer your Financial Data to third parties
- NOT use your Financial Data for any purpose other than testing the Tool's functionality
4.4 No Guarantee of Security. While we implement reasonable security measures, we CANNOT and DO NOT guarantee the security of your Financial Data. You upload Financial Data at your own risk.
4.5 Data Breaches. In the event of unauthorized access to or disclosure of your Financial Data, we will make reasonable efforts to notify you, but we assume no liability for such breaches.
5. ASSUMPTION OF RISK
YOU EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH USING THIS BETA TOOL, INCLUDING BUT NOT LIMITED TO:
- Inaccurate or incomplete credit analysis
- Loss, theft, or unauthorized access to your Financial Data
- Any financial decisions made based on the Tool's output
- Technical failures, bugs, or malfunctions
- Data corruption or loss
5.1 Sensitive Data Risk. You assume all risk for uploading sensitive financial data. If you do not want to assume this risk, do not upload such data and do not use the Tool.
6. DISCLAIMERS
6.1 AS-IS BASIS. THE TOOL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
6.2 No Financial Advice (Educational Purposes Only). The content and analysis provided by this app are for educational purposes only and should not be construed as financial advice. You should consult qualified professionals before making financial decisions.
6.3 No Accuracy Guarantee. We do not warrant that the Tool will be error-free, uninterrupted, or secure, or that any analysis will be accurate, complete, or reliable.
7. LIMITATION OF LIABILITY
7.1 Maximum Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULLDOZER ENGINEERING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
7.2 Direct Damages Cap. OUR TOTAL LIABILITY SHALL NOT EXCEED $0 (ZERO DOLLARS), REFLECTING THE FREE NATURE OF THIS BETA SERVICE.
8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Bulldozer Engineering from any claims arising from your use of the Tool, violation of these Terms, or the Financial Data you upload.
9. INTELLECTUAL PROPERTY
9.1 Our Rights. The Tool is owned by Bulldozer Engineering and protected by intellectual property laws.
9.2 Your Data. You retain all rights to the Financial Data you upload.
9.3 Feedback. Any feedback you provide becomes our property.
10. GOVERNING LAW
These Terms are governed by the laws of the State of Arizona, United States.
11. ACKNOWLEDGMENT
BY USING THE BULLDOZER CREDIT ANALYSIS TOOL, YOU ACKNOWLEDGE THAT:
- You have read and understood these Terms
- You agree to be bound by these Terms
- You assume all risks associated with using this Beta Tool
- This is a testing tool only and not a substitute for professional financial advice
- Uploaded data may be deleted at any time
